(ORAL) CM No.9894-CII of 2022 Allowed as prayed for. Affidavit-rejoinder of respondent to affidavit filed by the appellant is taken on record. Main Case Appellant is seeking setting aside of impugned judgment dated 02.12.2020 passed by the Additional Principal Judge, Family Court, Ludhiana.

As per order dated 23.08.2022, learned counsel for the respondent has handed over a cheque of Rs.1 crore as permanent alimony to learned counsel for the appellant and the same be bifurcated in the ratio of 60:40 for purchase of land in the name of minor daughter of parties i.e. Simarnoor Kaur, aged about 121⁄2 years and for her education. It is directed to the appellant that she will submit a report regarding this bifurcation within a period of three months. Further, both the learned counsel state that parties will withdraw all the cases arising out of this matrimonial dispute. FAO-21-2021 (O&M) is expected from the parties to maintain the healthy and strong atmosphere for the sake of their child.

Since, the statements of the parties have been recorded, nothing remains due, this Court has suo motu converted the present appeal into petition under Section 13-B of the Act for grant of divorce by way of mutual consent and also allowed the same. The parties are granted divorce by way of mutual consent and the impugned judgment dated 02.12.2020, is hereby set aside.
