**** RAJ MOHAN SINGH, J.(Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ directing the respondents to release the payment of final bill for the work done by the petitioner for constructing minors (khal) amounting to Rs.6,61,064/- along with interest.

Notice of motion was issued on 14.01.2020. Thereafter on 17.05.2022, none appeared on behalf of the petitioner. Learned counsel for respondents No.2 to 4 submitted that an approximate amount of Rs.9,50,000/- had already been released in favour of the petitioner towards the claim including the security amount. As on date, nothing is due to be paid to the petitioner.

CWP-731-2020  Following order was passed by this Court on 17.5.2022:- "Learned counsel for respondents No.2 to 4 submits that an approximate amount of Rs.9,50,000/- has already been released in favour of the petitioner towards his claim inclusive of security. As on date nothing remains to be paid to the petitioner. Learned counsel for the petitioner may respond to the aforesaid statement on the next date of hearing. List again on 06.08.2022."

As per office report, learned counsel for the petitioner has been informed telephonically about the date fixed i.e. today. None has appeared on behalf of the petitioner. It appears that after receipt of amount of Rs.9,50,000/- towards total claim of the petitioner, he is not willing to contest this case.

This Court has no alternative, but to dismiss this case at this stage with a liberty to the petitioner that in case something survives, he may move an appropriate application for revival of the case. Ordered accordingly.
