Petitioner is a land owner and by invoking contempt jurisdiction is seeking execution for payment of enhanced compensation awarded by this Court in his RFA 1574/2012 decided on 24.5.2016. Hon'ble the Supreme Court in Kanwar Singh Saini v High Court of Delhi, 2012(4) SCC 307, has held that contempt jurisdiction is attracted when there is disobedience of Court order or undertaking to Court is willful and contumacious and not for enforcement of decrees qua which the petitioner has proper and alternative remedy in accordance with law. At this stage counsel for the petitioner prays for permission to withdraw the instant petition.

Dismissed as withdrawn.
