**** Rajan Gupta, J. (Oral) Affidavit of Mr. Ajit Balaji Joshi, Deputy Commissioner, U.T., Chandigarh, has been filed in court today. Same is taken on record. Mr. Sehgal, has referred to Paras 2 and 3 thereof. Same read as under:- "2. That however, it was decided that the payment of compensation in the present case shall continue to be made by the Deputy Commissioner, Chandigarh, as there is no separate Head of Account for making compensation to the Children. Copy of letter dated 25.07.2017 is appended herewith as Annexure R-3.

3. That vide letter dated 1.10.2017 the Arrears have been cleared by the Deponent and a sum of Rs.56,800/- each has been paid to the victims. Copy of the said letter dated 1.10.2017 alongwith the photocopies of the cheques are appended herewith as Annexure R-4 and R-5. Thus the said delay had occurred due to the lack of funds and reshuffle of the same. The deponent however further undertakes to continue deposit the compensation in terms of the order passed by this Hon'ble court and accordingly tenders unconditional apology of said delay. "

In view of the above, no cause of action survives in this petition. Same is hereby dismissed.
