CWP 11285/2016 filed by petitioner was disposed of vide order dated 31.5.2016 by this Court directing respondents to take a decision on the demand notice of the petitioner and also to ensure that the liability to pay the interest element due to the delay in disbursement is also decided in view of the Full Bench judgment of this Court in A.S.Randhawa v State of Punjab and others, 1997(3)SCT 468. Now alleging disobedience of said order instant contempt has been filed.

At the time of hearing today, reply by way of affidavit of Kamal Kishore Yadav,IAS,Director Department of Local Government,Punjab has been filed stating therein that in compliance of the order dated 31.5.2016, a speaking order dated 7.12.2016(R-1/1) has been passed whereby petitioner was not found entitled to any interest. It is further submitted that retiral benefits were released to the petitioner on various dates, as detailed in Annexure R-1/2. COCP 2663/2016 payment of retiral benefits is attributed to financial constraint for which unconditional and unqualified apology has been tendered. The affidavit is taken on record.

In view of contents of affidavit, instant contempt is dismissed as having become infructuous.
