Learned counsel appearing for the respondents submits that petitioner did not prefer a separate writ petition in support of his claim. He has relied upon the general directions given by court in CWP No. 10941 of 2010 & CWP No. 6684 of 2014. Yet his case was considered by the authority on his representation, Annexure P13 and was rejected vide order dated 03.01.2017 (Annexure R3). Besides, at the time of issuance of notice of motion, petitioner had prayed that his case be listed alongwith COCP No. 1528 of 2016. According to counsel for the respondents, said case has been dismissed as withdrawn vide order dated November 11, 2016. In view of stand taken by authority, no cause of action survives in this petition. Petition is hereby dismissed. Rule is discharged. Needless to observe that petitioner is entitled to challenge the speaking order, if he is aggrieved by the same.
