(ORAL) [1] Status report by way of affidavit of Shri Manjeet Singh, PPS, Deputy Superintendent of Police, City-2, Bathinda, District Bathinda, on behalf of respondent No.1-State has been filed in Court today. The same is taken on record. Copy thereof has been supplied to learned counsel opposite.

[2] On 10.01.2024, the following order was passed by this Court:- " Present:

Mr. Manish Bansal, Advocate and Mr. Navjit Singh, Advocate for the petitioner.

***** By way of present petition filed under Section 438 Cr.P.C., petitioner prays for grant of anticipatory bail in case FIR No.0127 dated 22.09.2023 registered under Sections 457, 380, 427, IPC at Police Station Cantt. Bathinda, District Bathinda.

As per allegations, petitioner was earlier a tenant under the complainant. Petitioner left the premises prior to the date fixed in the agreement. Besides, he took away lights, ceiling fans, curtains etc., broke the doors and almirahs and did not pay the electricity bill. It is contended by learned counsel for the petitioner that the petitioner has been falsely implicated; that it is the petitioner who got done the white wash and repair of the house. There was no fan, light etc., at the time of taking the premises on rent. It is also contended that petitioner had earlier informed about the vacating of the premises. Learned counsel also contends that dispute is purely of civil nature, which has been given the criminal colour.

Ms. Kanica Sachdeva, AAG, Punjab, accepts notice on behalf of the respondent- State. Copy of the petition be supplied to her during course of the day.

In the meantime, in case of his arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/ Investigating Officer. However, it is further directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C. " [3] Today, learned State Counsel, on instructions from HC Jas Karan Singh, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 10.01.2024 and is no longer required for further investigation. [4] In view of the aforesaid, the order dated 10.01.2024, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
