***** Rajan Gupta, J. (Oral) Learned State counsel, at the outset, points that the matter has been decided by the LPA Bench in LPA No.464 of 2016 on 14.12.2016. Operative part thereof reads as under:- "2. On 12.12.2016, learned counsel for the respondents had submitted that the regular enquiry was held against the appellants on 20.07.2016 and order for their removal was passed on 02.11.2016. It was further stated that the implementation of the said order was kept in abeyance vide order dated 30.11.2016 because of the pendency of the present LPA. Learned counsel for the appellants prayed for time to examine the same.
3. It was not disputed that the order dated 02.11.2016 is any appealable order. Accordingly we dispose of the present appeal with permission to the appellants to assail the order dated 02.11.2016 in accordance with law and also permit that in case Sukhpreet Kaur 2017.03.28 16:05 I attest to the accuracy and integrity of this document
COCP-2721-2016 (O & M) ::2::
a statutory appeal is filed within seven days from today, same shall not be dismissed on the ground of limitation, as accepted by learned State counsel. It was stated by learned State counsel that during the period of next seven days order dated 02.11.2016 shall not be implemented."
In view of the above, no cause of action survives in this petition. Same is hereby disposed of.
Rule is discharged.
