Petitioner company was held entitled to the refund of entire amount deposited by it towards purchase of a Five Star Hotel site situated in Sector 47, Gurgram in terms of the judgment/order dated 24.1.2017 passed by learned Single Judge of this Court.

At the time of hearing, it is conceded that the aforesaid judgment is subject matter of LPA No.1835/2017 wherein operation of the aforesaid direction passed by learned Single Judge has been stayed and LPA is stated to be listed for hearing on 22.2.2018. In view of doctrine of merger, no case for invoking contempt jurisdiction is made out.

Dismissed.
