**** RAMENDRA JAIN, J. (ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner in a case arising from FIR No.89 dated 09.04.2015, under Sections 380, 420, 465, 467, 468, 471 and 120-B IPC, Police Station Kotwali, District Bathinda, in which petitioner has been convicted by learned Chief Judicial Magistrate, Bathinda vide judgment and order dated 11.08.2017 (P-1) and his bail bonds and surety bonds have been cancelled due to non-appearance.

In nutshell, petitioner is facing trial in aforesaid FIR No.89 dated 09.04.2015. On 02.01.2019, the petitioner absented during trial, therefore, his bail bonds and surety bonds were cancelled and he was ordered to be summoned through non-bailable warrants. CRM-M-900 of 2019 --2-- 02.01.2019 was not intentional, rather, was on account of jotting down wrong date.

In the fitness of things, the petitioner is directed to appear before the trial court within 7 days and his bail application, shall be decided by the trial court within next 7 days on merit. The observation made in this order shall have no bearing on the merits of the case while deciding the bail application of the petitioner.
