Jaswant Singh,J(Oral) Petitioner had filed contempt petition bearing COCP 525/2016 alleging disobedience of the order dated 4.7.2014 passed by this Court in CWP 12643/2014, filed by him, whereby respondents were directed to consider and decide the representations of the petitioner concerning payments in respect of works executed by him. Upon notice, respondents put in appearance and filed written statement also.

This Court, after considering the reply filed by respondents, disposed of said contempt petition vide order dated 9.9.2016 and also issued notice to the petitioner for concealing the fact regarding execution of receipt by him in respect of payments received by him. In compliance with the order dated 9.9.2016 passed in COCP 525/2016 instant contempt petition bearing COCP 2759/2016 titled Court on its own motion v Hanuman Prasad has been instituted.

Vide order dated 18.11.2016 bailable warrants in the sum of Rs.10,000/- were issued for securing the presence of the Rajinder Parshad Joshi 2017.02.06 11:31 I attest to the accuracy and integrity of this document

COCP 2759/2016 respondent/contemner.

Today, at the outset counsel for the respondent/contemner states that the receipt dated 22.10.2014 was got executed in the office of Municipal Committee, Bawani Khera, Distt.Bhiwani with the assurance that the necessary payment by cheque(s) would be released the moment President, Municipal Committee, Bawani Khera would arrive in her office. However, the promised cheques were not issued. It is also stated that some amount as bribe was also demanded.

Learned counsel for the contemner further submits that without going into the details of the allegations his client tenders his unqualified apology and is also willing to accept any punishment for not-disclosing the contents of the receipt executed on 22.10.2014 while filing COCP 525/2016.

After hearing the counsel as also the contemner, the unqualified apology tendered is accepted and the present contempt petition is disposed of with a direction to contemner-Hanuman Parshad to deposit a sum of Rs.10,000/- (Rupees ten thousand only) with Shri Krishan Gaushala, Bhiwani within three weeks from today with prior intimation to the office of Deputy Commissioner, Bhiwani.

Disposed of in the above terms.
