Dated Police Station Sections 19.11.2020 City Tarn Taran, District 307/148/149/427 IPC, 1860 & Tarn Taran 25/27 of Arms Act, 1959 The petitioners, arraigned as accused in the above captioned FIR, have come up before this Court under Section 482 CrPC for quashing of the FIR on merits because as per the accused no case is made out.

The State strenuously opposes the petition.

A perusal of the memo of parties reveals that the petitioners did not arraign the victim as a respondent and he seeks quashing of his allegations at his back. This is impermissible in law.

Given above, the petition is dismissed in the terms mentioned above. However, liberty is reserved to the petitioners to file a fresh petition by arraigning the victim(s) as respondents.
