Respondent filed suit seeking the relief of permanent injunction to restrain the defendant-petitioner from interfering in his peaceful possession over the passage of 11'x30' shown as 'ABCD' in the site plan and his suit was decreed. Appeal against the judgment of learned Civil Judge was dismissed by learned Additional District Judge, Sonepat. Regular Second Appeal filed by the petitioner was admitted and parties were directed to maintain status quo. The order of status quo pertains to the subject matter of the suit and not beyond that. Learned counsel for respondent has submitted that construction is being raised after leaving passage of 11' x 30' shown as 'ABCD' in the site plan, out of his 17 marlas land purchased vide registered sale deed dated SACHIN MEHTA 2020.01.29 10:44 I attest to the accuracy and authenticity of this document High Court, Chandigarh

Learned counsel for the petitioner feels satisfied with the submission of learned counsel for the respondent to this effect. In view of the same, no further action is required in this petition. The same is disposed of with liberty to the parties to raise their pleas at the time of disposal of the regular second appeal with regard to the area where the construction is being raised.
