Notice of motion.

On the asking of court, Mr. Rohit Arya, Asst. A.G. Haryana, who is present in court, accepts notice on behalf of the respondent. Petitioner alleges violation of order dated 03.04.2017 passed by writ court. Operative part thereof reads as under:- "This petition is disposed of, at this stage, with a direction to the Secretary-cum-Member. RTA, Gurgaon to consider legal notice of the petitioners, Annexure P-4 dated 19.01.2017 within a period of two months by passing a speaking order after the receipt of certified copy of this order.

In case, the petitioners are required to explain the circumstances by availing personal hearing, the same may also be granted to the petitioners.

It will be the responsibility of the petitioners to communicate the order to the above said authority."

Learned State counsel submits that in case needful has not been done till now, immediate steps shall be taken to pass a speaking order in terms of the direction.

It is, however, made clear that in case any fresh cause of action for contempt accrues to the petitioners, this court shall consider imposition of exemplary costs which shall be deducted from the salary of the officers responsible for delay/non-compliance.
