CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Sunil Kumar Nehra, Advocate, For the petitioner.
Mr. D.S.Nalwa, Additional A.G, Haryana.
**** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of certiorari for quashing the impugned suspension order dated 16.12.2019 (Annexure P-5).
Learned State counsel, at the outset, submits that during pendency of the proceedings, petitioner has retired on attaining the age of superannuation and, therefore, proceedings before this Court are rendered infructuous. Disposed of as having been rendered infructuous. However, learned counsel for the petitioner would submit that petitioner is apprehensive that he may not be accorded the pensionary benefits in view of the suspension order being not formally set aside by this court. Be that as it may, since there was an interim stay on implementation of suspension order and resultantly petitioner continued to work and has been remitted entire salary for the corresponding period, no further grounds are made out to interfere at this stage.
Needless to say, any further adverse orders passed by the department, if any, petitioner is at liberty to challenge the same. (ARUN MONGA) JUDGE July 21, 2022 Vandana Whether speaking/reasoned:
