Petitioner filed CWP 10726/2016 seeking issuance of writ of mandamus directing the respondent concerned to regularize the services of the petitioner against a suitable Group-D post with effect from the date of regularization of her junior i.e. 27.2.2012 with all consequential benefits. The said writ was disposed of by this Court vide order dated 27.5.2016 directing respondent concerned to take a decision on the legal notice dated 5.4.2016 issued on behalf of the petitioner by passing a speaking order after affording opportunity of hearing preferably within four months from the date of receipt of certified copy of the order.
Now alleging disobedience of said order dated 27.5.2016 Rajinder Parshad Joshi 2017.05.04 10:03 I attest to the accuracy and integrity of this document
COCP 2912/2016 instant contempt has been filed.
At the time of hearing today short reply by way of affidavit of Sunita Devi,District Education Officer,Rohtak has been filed stating therein that in compliance of the order service petitioner has been regularized vide order dated 17.3.2017 w.e.f. 27.2.2012, i.e. the date her junior Jai Bhagwan was regularized and arrears released through cheque dated 26.4.2017. Copy of the order dated 17.3.2017 regularizing service of the petitioner has been annexed as Annexure R2 with the affidavit filed today whereas copy of order dated 18.3.2017 fixing the pay of the petitioner has been annexed as Annexure R-3. The affidavit filed today is taken on record alongwith said Annexures. In view of the contents of affidavit filed today and the Annexures R-2 and R-3, it is apparent that the instant contempt petition has been rendered infructuous.
Ordered accordingly.
