1. The petitioners by way of this writ petition pray to stay the notification dated 07.12.2023 whereby the examination of JE and Senior Assistant/Inspector was announced to be held on 20.01.2024 onwards.

2. Learned counsel submits that the said examination is a re-examination being conducted in relation to the earlier advertisement for filling up the post of JE/Senior Assistant/Inspector. The original examination, which was conducted, was scrapped by the authorities on the ground of there being some bungling for which an FIR dated 06.04.2016 was registered by the Vigilance Bureau.

Learned counsel submits that the petitioners are those who participated in the earlier examination and had achieved higher marks, but on account of the FIR registered, they are now facing trial which is being directed to be concluded within six months by this Court in CRM28840-2023. Learned counsel submits that the respondents ought to wait for the result of the criminal case, and should not conduct examination.

4. I have considered the submissions.

5. This Court finds that the decision to scrap the earlier examination was challenged before this Court in writ petition, and the same was upheld by this Court. The entire examination was cancelled. In view thereof, merely because the petitioners scored higher marks in the earlier examination, would not given them any right or claim. So far as the criminal case is concerned, the same is only examining the criminal culpability of the petitioners and has no relevance to the re-conducting of the examination by the respondents.

6. In view of above, this writ petition fails and is found to be de hors merits.

7. Writ petition stands dismissed accordingly.
