Mr.Rohit Arya, AAG, Haryana Rajan Gupta, J (Oral) Learned State counsel seeks to place on record status report by way of affidavit of Ashvir Nain, District Development & Panchayat Officer, Bhiwani. Para Nos. 3 & 4 reads as under:- "That as per the report all the 5 cases were fixed on 15.5.2017 for site inspection. Tehsildar Bhiwani and BDPO Bhiwani were also written letter vide Memo no.1165-66/Reader dated 8.5.2017 to inform the illegal encroachers about site inspection. On 15.5.2017 the site was inspected by the SDO (Civil), Bhiwani in the presence of Tehsildar, BDPO, Halka Kanungo, Gram Sachiv, Sarpanch Gram Panchayat, Mandhana, Social Education Panchayat Officer, Bhiwani. The statements of witnesses have been taken who were present at the spot and the defendants were directed to submit any documents in their favour on 19.5.2017 in the court. That on 19.5.2017 one witness namely Krishan Kumar S/o Ram Chander R/o Mandhana filed an affidavit in his evidence and case has been fixed for cross examination and argument for 26.5.2017."
Learned State counsel further submits that all efforts are being made to get the illegal encroachment removed from the site in question. The order passed by the writ court has already been complied with by
COCP No. 2921 of 2016 2 passing the speaking order Annexure R/1.
In view of above, no further direction is necessary. Petition is disposed of. Rule is discharged.
Petitioners shall, however, be at liberty to avail appropriate remedy if any cause of action subsits.
