Petitioner filed CWP 21400/2013 challenging the action of the respondent authorities in not regularizing his services from the date when his juniors were regularized i.e. w.ef.1.10.2003. The said writ petition was disposed of by this Court vide order dated 7.5.2015 holding petitioner entitled to regularization from the date his juniors had been regularized i.e. 1.10.2003. The petitioner was also held entitled to consequential benefits which were ordered to be released within a period of three months from the date of receipt of copy of the said order.
Alleging disobedience of said order instant contempt has been filed.
Upon notice short reply by way of affidavit dated 6.1.2017 Rajinder Parshad Joshi 2017.03.21 16:19 I attest to the accuracy and integrity of this document
COCP 2939/2016 of Pardeep Kumar,Superintending Engineer,Public Health Engineering Circle,Jhajjar was filed. At the time of hearing today, additional affidavit dated 16.3.2017 of said officer has bee filed stating therein that after obtaining necessary approval from the Government the services of petitioners have been regularized w.e.f. 1.10.2003 vide order dated 3.3.2017. The delay in implementing the order of this Court has been attributed to the process of taking necessary approval from the Government. An unconditional apology has also been tendered. Besides that another affidavit of petitioner dated 15.3.2017 has been produced wherein he has given no objection in case the present contempt is dismissed as nothing more survives in the present contempt. Both the aforesaid affidavits are taken on record. In view of the above, present contempt petition is dismissed as having become infructuous.
