Petitioner filed CWP 24396/2012 seeking benefits of Rule 8(A) (i) of the Punjab Recruitment of Ex-servicemen Rules,2004. The said writ petition was allowed vide order dated 5.2.2015 whereby he was granted benefit of increments for the period spent by him in military service and consequential pay re-fixation and calculation of pension. The arrears of such relief were however, restricted to a period of three years.

Alleging non-compliance of said order, present contempt has been filed.

On the last date of hearing, counsel for the respondent submitted that the present petition has become infructuous as the Rajinder Parshad Joshi 2017.03.07 09:41 I attest to the accuracy and integrity of this document

COCP 294/2016 necessary relief has since been granted to the petitioner. The proxy counsel,appearing for the petitioner prayed time to seek instructions. At the time of hearing today,learned State counsel,on instructions again submits that necessary relief has been granted and bills/payments will be released within next two weeks. Learned counsel appearing for the petitioner does not dispute the submission made by learned counsel for the petitioner. In view of the above,in my opinion, no further action is warranted in the present contempt petition.

Dismissed as infructuous.
