Notice of motion.

On the asking of court, Mr. Harsimran Singh Sethi, Addl. A.G. Punjab. who is present in court, accepts notice on behalf of official respondents.

Petitioner alleges violation of order dated 22.02.2017 passed by this court, operative part thereof reads as under:- "After having heard learned counsel for the parties and on perusal of the orders passed by the Co-ordinate Bench of this Court, this writ petition is being disposed of with direction to the respondents to consider the case of the petitioner in the light of the judgment rendered in Constable Rajesh Kumar's case (supra). In case, the petitioner is found to be entitled for the said relief and in case the ratio of the judgment rendered in Constable Rajesh Kumar's case (supra) is applicable to the petitioner, the necessary benefits be granted to him within a period of three months from the date of the receipt of a certified copy of this order. In case, the petitioner is not found entitled to the relief as sought then a speaking order be passed Ajay Kumar 2017.10.11 15:35 I attest to the accuracy and authenticity of this document

COCP No. 2896 of 2017 and the petitioner is at liberty to avail the remedies available to him in accordance with law."

Learned State counsel at the outset submits that in case no appeal is pending, aforesaid order shall be complied with at the earliest, in any case no later than one month.

In view of statement made by learned State counsel, no further direction is necessary. Disposed of. It is made clear that in case any fresh cause of action accrues to the petitioner to invoke contempt jurisdiction of this court, it shall consider imposition of exemplary costs which shall be deducted from the salary of the official(s) found guilty for delay/noncompliance.
