The present contempt has been filed with the averment that this Court in RSA 516/2016 decided on 27.4.2017 had restored the judgment and decree dated 29.11.2003 passed by the trial Court/Additional Civil Judge (Senior Division)Garhshankar decreeing suit for mandatory injunction.

It cannot be disputed that the decree is executable and for its violation,if any, procedure is prescribed under Order 21 CPC. At this stage,counsel prays for permission to withdraw the instant contempt to enable his client to seek his remedy in accordance with law.
