RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerRaj Kumar @ Chuchu, has prayed for grant of regular bail in case FIR No. 529 dated 16.09.2019 registered under Sections 323, 324/34 and 506 IPC (Sections 307 and 201 IPC and Sections 25 and 27 of the Arms Act, added later on) at Police Station City Sonipat, District Sonipat. According to prosecution, in the night time of 15.09.2019, after abusing the complaint, petitioner caught-hold him from behind while, Binni @ Vinay son of the petitioner, inflicted knife blows in the stomach of complainant. Raising alarm by the complainant, attracted many people at the spot. Thus, petitioner along with his son fled away from the spot, extending threat to the life of complainant. Learned counsel inter alia contends that petitioner is in custody since 17.09.2019. He has falsely been implicated. CRM-M-793-2020 -2been framed. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. Nothing has to be recovered from him.
On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Raj Kumar @ Chuchu, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
