JASWANT SINGH, J (ORAL) In this Contempt Petition, the petitioner-wife, who had prayed for stepping up the pay of her late husband-Kamal Bagirath, working as Superintendent with the Punjab School Education Board, Mohali), with his junior Malagar Singh, has alleged that the respondents being contemnors herein, have wilfully violated the order dated 20.10.2015 passed by this Court in CWP No.21326 of 2014, directing the respondents to release benefits due to the petitioners, in terms of order dated 22.7.2015 expeditiously preferably within a period of two months, and thus, having failed to do the needful, they should be dealt with under the provisions of Contempt of Courts Act, 1971.

Upon notice, reply by way of affidavit dated 11.1.2017

COCP No.2980 of 2016 #2# of Ashok Pajni, Examiner, Local Fund Accounts, Punjab, Chandigarh has been filed on behalf of respondent No.2 averring that the order has been complied with and the pay of the petitioner has been re-fixed vide R.2/1 thereby rendering the present contempt petition as infructuous.

Accordingly, the petition is dismissed having become incapable of any further relief being granted and the rule is discharged.
