*** JASWANT SINGH, J.(ORAL) By filing the instant contempt petition under Section 12 of the Contempt of Courts Act, the petitioner, who was working as Conductor on regular basis in the respondent-Department, has alleged non-compliance of the order dated 11.5.2016 (P-1) passed by this Court directing the respondents to count the services of the petitioner w.e.f 05.6.1982 till his retirement i.e 31.12.2011 and re-fix his pension accordingly, within three months from the date of order.
Upon notice, short reply by way of affidavit dated 23.2.2017 of Ram Kumar, General Manager, Haryana Roadways, Kaithal has been filed asserting that after examination of the record, the claim of the petitioner has been accepted and pension fixed accordingly thereby rendering the present petition as infructuous.
In view of aforesaid, present petition is dismissed for having become incapable of any further relief being granted and the Rule is discharged.
