CP-148-2004 This is a complaint filed by the Official Liquidator under section 454(5) of the Companies Act, 1956 read with Rule 125 and 132 of the Companies (Court) Rules, 1959. This petition is pending for the last 18 years. It has been brought to the notice of the Court that respondent No.1, 2, 3, 9 and 10 were discharged, whereas, respondent No.7 died. Respondent No.8 was declared as proclaimed offender, whereas, bailable warrants were issued against respondent No.4. It has been reported that he is not found residing at the given address. Respondent No.5 and 6 were represented by Mr. O.P. Sharda, Advocate, who stopped appearing after 27.10.2014. The proceedings for dissolving the company (in liquidation) are held up due to the pendency of the present complaint. Already 18 years have elapsed, no fruitful purpose is likely to be served in continuing the present complaint. Hence, the matter is ordered to be closed.
