In view of the separate order dated 29.5.2009 passed in CP No.77 of 2007, M/s Modern Financier Pvt. Ltd. Vs. Reserve Bank of India, whereby voluntary winding up petition filed by M/s Modern Financier Ltd. has been admitted and the Official Liquidator has been appointed as Provisional Liquidator, the present petition is disposed of as infructuous, however, with the liberty to the petitioner to get the same revived in case the respondent-Company comes out of liquidation.
