1$7(89   Petitioner Shakti has filed instant petition under Section 482 of 3( : 4( ;&0(;!3&"3 1 % for grant of anticipatory bail in FIR No.186 dated 03.07.2024 under Sections 354, 323, 427 and 506 of IPC registered at Police Station Civil Lines Batala, District Batala.  2.

Facts of the case are that complainant Simran gave her statement that about few days ago at night time male members in her house had gone to somebody's house with the respectables regarding some ongoing dispute related to a scuffle. She was present in the house along with her nephew aged about 1 1⁄2 years, sister-in-law Sangeeta and another sisterin-law Anjali. Her nephew went outside the house and she went behind him.

 Around 7-8 persons namely Shakti Mahant, Robin, Rajeev, Bablu, Varinder and some unknown persons broke down CCTV camera installed outside their house and they started throwing bricks and stones towards their house. A piece of brick hit on head of her nephew Abhimanyu and he became unconscious. Anjali and Sangeeta brought him inside the house. Rajeev raised lalkara as a result 7-8 persons attacked them with their deadly weapons. She was given blows with datar by Robin. She ran inside the house to save herself. Bablu, Rajeev and Varinder pushed her and outraged her modesty. She raised hue and cry and tried to defend herself. She was given kick blows. People in the neighbourhood tried to save her. Mahant Shakti took out 2 illegal weapons and threatened them not to come close. On seeing people gathering on the spot, assailants left the spot. After sometime son of her uncle came and took her to Civil Hospital Batala for treatment.  3.

Learned counsel for petitioner pointed out that he has already joined the investigation and fully cooperated with the investigating agency. Alleged weapon has been recovered. He is still ready to abide by the terms of bail order.

Status report has been filed confirming the registration of FIR and the facts detailed therein regarding present petitioner. It is confirmed that he has joined the investigation and weapon is also recovered. On instructions of ASI Mangal Singh, it is pointed out that petitioner is not required for further investigation.

Considering the aforesaid factual position, it is clear that petitioner has already joined the investigation and fully cooperated with the Investigating Agency. No purpose would be served by sending him behind the bars. Considering the aforesaid factual position, anticipatory bail filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023. $  "+ "4. !
