**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 99 dated 26.8.2019 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station City Rampura, District Bathinda. Custody certificate by way of affidavit of Deputy Superintendent, Central Jail, Bathinda has been filed through e-mail. Copy of the same is taken on record.

Learned counsel for the petitioner submits that recovery of 960 tablets of Clovidol-100 SR was allegedly effected from the petitioner. Learned counsel further submits that the petitioner has been in custody from the last more than one year and there is no other case against him. Learned counsel for the petitioner further submits that the allegations against the petitioner are that on seeing the police party, he GURPREET SINGH 2020.09.18 17:46 I attest to the accuracy and integrity of this document Chadigarh threw the bag on the side of the road, which was later on recovered and the

CRM-M No. 689 of 2020 -2contraband was found in the said bag.

Learned State counsel has not disputed the fact that there is no other case against the petitioner. However, he submits that the recovery effected from the petitioner falls under the commercial quantity. As per the custody certificate, the petitioner has been in custody from the last more than one year. The trial will take time to conclude because of COVID-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
