Mr. Aditya Bhushan, Advocate for the petitioner. RAJIV SHARMA,J Prayer in the instant writ petition preferred under Article 226 of the Constitution is for issuance of a writ of Mandamus directing respondent No.1-State Bank of India not to take possession of the property qua the share of the petitioner.
Learned counsel for the petitioner submits that the petitioner filed S.A before the Debt Recovery Tribnal-II, Chandigarh though the matter could not be taken up since the Presiding Officer was on leave and that respondent No.1-Bank is adamant to dispossess the petitioner from the suit property.
After having examined the contents of the petition and taking into account the facts & circumstances of the matter, present petition is disposed of with a direction to the Debt Recovery Tribnal-II, Chandigarh to decide the lis within a period of four weeks from today. Till then, no coercive steps shall be taken against the petitioner.
