(Presence marked through video conference) *** ARUN MONGA, J. (ORAL) Petitioners herein, inter alia, seek issuance of a writ in the nature of mandamus directing the respondents to step up their pay equivalent to those who have been appointed directly on the post of Deputy Registrar, Cooperative Societies. They have been promoted to the post of Deputy Registrar, Cooperative Societies and are drawing less salary than their counterparts, who are direct recruits.
2. Learned counsel submits that as per the Haryana State Cooperative Societies, Group A Service Rules 1996, 2/3rd of Deputy Registrar can be appointed by way of promotion and 1/3rd directly. There is no other difference stipulated in the Rules. He submits that petitioners qua their aforesaid grievance caused issuance of a legal notice dated 09.11.2021 (Annexure P-3), but to no avail. Hence, the instant petition.

On advance service, learned State counsel joins proceedings and opposes issuance of notice of motion and submits that competent authority shall take decision either way, on the pending legal notice of the petitioners, in due course.

Learned counsel for the petitioners also agrees that let a final decision be taken, by the competent authority on the pending legal notice dated 09.11.2021 (Annexure P-3).

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioners as per legal notice dated 09.11.2021 (Annexure P-3) and also contentions raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law, as expeditiously as possible.
