**** Rajan Gupta, J. (Oral) Learned State counsel has referred to Para 5 of affidavit dated 01.11.2017. Same reads as under:- "5. That as soon as copy of the aforesaid order of this Hon'ble Court and coy of the representation in question were received, the Executive Engineer, Eastern Canal Division, Ferozepur passed the speaking order vide ref. No.1657-66 dated 01.11.2017 (copy also sent to the petitioner) and he took the following steps:- (a) The estimate for the work at Sr. No.(i) was got sanctioned on rough cost basis vide Chief Engineer/Canal, Irrigation Works, Punjab, Chandigarh letter No.2501 dated 24.03.2017 for Rs.20,95,538/- and now revised estimate is required to be sanctioned.

(b) The payment would be made to the plaintiff after completing the Departmental formalities and still State Vigilance checking report has not been received. After receiving the report from the concerned department payment for the above said works will be released after amending the amount as per report.

It is submitted that the higher authorities have been informed for arranging funds for releasing the payment of the bills to the petitioner. Copy of the speaking order is annexed herewith as Annexure R-1/T.

A query has been put to learned State counsel as to how much time the enquiry proceedings shall take to conclude. She, however, submits that the enquiry being with the Vigilance Bureau, Punjab, it would not be possible to specify the time-limit. However, efforts shall be made to conclude the same expeditiously.

In view of the above, present petition is hereby disposed of. Petitioner shall, however, be at liberty to file afresh in case enquiry proceedings do not conclude within a period of four months.
