Present:
Mr. Raj Kumar Gupta, Advocate for the petitioners. Mr. Sanjiv Gupta, Advocate for the respondent. JASWANT SINGH, J (ORAL) The petitioners were respondents in two of the appeals bearing RSA No.2400 of 2005 and 2080 of 2005 filed by the respondent herein along with another. Both the appeals were disposed of vide two separate orders dated 19.12.2014, in terms of a written compromise dated 05.8.2014 along with site plan (annexed herewith as P.4 and P.5). The two petitioners Arjun Dev and Satish Kumar have filed the present contempt with the allegation that the respondent-Smt Murti Devi is threatening to encroach upon some portion of the land of the petitioners in violation of the terms and conditions of the decree dated 19.12.2014 passed in view of the compromise.
Upon notice, written reply has been filed wherein it is inter alia alleged that the answering respondent i.e Murti Devi has never backed out of the compromise.
After hearing learned counsel for the parties and keeping in
COCP No.3143 of 2015 #2# view the nature of the dispute raised, it is deemed appropriate to relegate the parties to seek the execution of their aforesaid decrees. Ordered accordingly.
No further action is warranted in the matter. Disposed of.
