Petitioner alongwith others filed CWP 7656/2015 seeking a writ of mandamus to direct the respondents to consider their claim for promotion from the posts of Panchayat Officer and Superintendent Grade-II to the posts of Panchayat Officer and Superintendent Grade-II to the post of Executive Officer. The said writ petition was disposed of vide order dated 19.5.2015 with a direction to respondents to consider and decide the claim of petitioners, as set out in their representation dated 7.6.2014 within a period of three months from the date of receipt of certified copy of the order.
Now alleging disobedience of said order instant contempt has been filed.
At the time of hearing today, affidavit of Siban C, Director, Rural Development and Panchayats,Punjab has been filed stating therein that representation of the petitioners was decided by passing a speaking order on 9.1.2017(R-1) whereby their claim was rejected. COCP 3166/2015 the delay caused in deciding representation, unconditional apology has been tendered. The affidavit is taken on record. In view of contents of affidavit, instant contempt is dismissed as having become infructuous.
