Harpreet Singh v. State Of Punjab

Apprehending his arrest in FIR No.141 dated 22.11.2023 registered for offence punishable under Sections 21(1) of Mines & Minerals (Development & Regulation) Act, 1957 at P.S. Hariana, Hoshiarpur, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail. Inter-alia submits that there is no allegation that the petitioner was present on the spot and he is apprehending his arrest merely for the reason that he happens to be the owner of the vehicle involved.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C."
