Instant petition has been filed under Article 226 of the Constitution of India for issuance of direction to the official respondents No.2 and 3 to protect the life and liberty of the petitioner at the hands of private respondents. A further prayer has been made for issuing direction to respondent No.2 to look into the representation dated 15.12.2020 submitted by the petitioner and to take necessary action as per law. Counsel for the petitioner submits that as a result of an occurrence which took place on 08.11.2019, FIR No.469 dated 09.11.2019 was registered under Sections 307/341/506 of Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959 at Police Station City Barnala in which SAVITA KADIAN 2021.01.12 16:16 I attest to the accuracy and integrity of this document High Court Chandigarh
CRWP No.288 of 2021 {2} the petitioner was named as one of the accused. After investigation, a cancellation report dated 30.11.2019 (Annexure P-1) has been submitted by the investigating agency. The petitioner had submitted a cross-complaint to the jurisdictional SHO, but no action has been taken thereon. He has also submitted a representation dated 15.12.2020 (Annexure P-2) to the Senior Superintendent of Police, District Barnala, which is pending. Counsel for the petitioner confines his prayer to issuance of a direction to the official respondent No.2 to examine the representation dated 15.12.2020 (Annexure P-2).
Without adverting to the merits of the petitioners' allegations at this stage, the present petition is disposed of with a direction to Senior Superintendent of Police, District Barnala-respondent No.2 to consider the representation dated 15.12.2020 (Annexure P-2) and thereafter, to take appropriate steps as warranted, in accordance with law. A copy of this order alongwith copy of representation, Annexure P-2 be sent to the Senior Superintendent of Police, District Barnala respondent No.2 to enable him to do the needful expeditiously.
