Jaswant Singh,J(Oral) While dismissing CWP 5767/2017 filed by Union of India, challenging grant of benefit of Modified Assured Career Progression Scheme(MACP) to petitioner herein by Central Administrative Tribunal,Chandigarh, this Court vide order dated 9.9.2014(P-1) had directed the respondents to release arrears of pay, revised pension etc. as early as possible but not later than four months from the date of receipt of certified copy of the said order.

In the present contempt disobedience of said order dated 9.9.2014(P-1) is alleged.

Upon notice, additional affidavit dated 6.2.2017 of Sh.T.C.Verma,Officer Incharge, Military Farm,Jalandhar Cantt has been filed today on behalf of respondents. The same is taken on record. In the said additional affidavit dated 6.2.2017 it is averred that arrears totaling Rs.1,72,241/- could not be credited to the account of the petitioner earlier as he got transferred his pension account from Punjab National Bank, Jalandhar Cantt Branch to Punjab National Rajinder Parshad Joshi 2017.02.08 16:57 I attest to the accuracy and integrity of this document

COCP 3231/2015 Bank,Ganganagar, Meerut without intimating the pension office. On coming to know about the change of pension account of petitioner, now the pension payment order has been forwarded to the Central Pension Processing Cell,PNB,Hazrat Ganj,Lucknow by CPPC,Punjab National Bank,Ludhiana vide letter dated 2.2.2017. On receipt of said PPO by the Lucknow Branch, the benefits would be credited to the account of the petitioner by the bank itself. Calculation sheet of arrears of pension etc., has been annexed as Annexure R-3 with the said additional affidavit. In view of the contents of the additional affidavit counsel for the petitioner concedes that the present contempt petition has been rendered infructuous.

Disposed of as having become infructuous.
