(ORAL) [1] Status report by way of affidavit dated 26.02.2024 of Shri Achhru Ram Sharma, PPS, Deputy Superintendent of Police, Sub Division, Jalalabad, on behalf of the respondent-State has been filed in Court today. The same is taken on record. Copy thereof has been supplied to learned counsel opposite.
[2] On 11.01.2024, the following order was passed by this Court:- " Present:
Mr. Neeraj Madaan, Advocate for the petitioner. **** By way of this petition filed under Section 438 Cr.P.C., petitioner prays for grant of anticipatory bail in case FIR No.67 dated 24.05.2023, under Sections 324, 323, 34 of IPC (Section 326 IPC added later on vide DDR No.22 dated 17.10.2023), registered at Police Station Sadar Jalalabad, District Fazilka.
It is contended by learned counsel for the petitioner that though the alleged occurrence took place on 25.04.2023 at about 3.30 p.m., but the FIR was lodged on 24.05.2023, i.e. after almost about a month of the occurrence, in which allegations of causing simple injuries, attracting only Sections 324 and 323, 34 of IPC were made. Later on, after more than 05 months, Section 326 IPC was added, as per DDR dated RAJNEESH SHARMA 2024.02.26 05:10 I attest to the accuracy and integrity of this document
2024:PHHC:025733 CRM-M-1229-2024 -217.10.2023 on the basis of opinion of the Board of doctors to the effect that fracture was found on the middle phalanx of the little finger of left hand of the complainant, i.e. non-vital part of the body. Learned counsel for the petitioner contends that said injury has been manipulated, so as to involve the petitioner for a serious offence. Notice of motion.
Ms. Kanica Sachdeva, AAG, Punjab accepts notice on behalf of the respondent-State. A copy of paper book be supplied to her during the course of day.
Adjourned to 26.02.2024 for filing status report. In the meantime, petitioner is directed to join investigation and co-operate in the same. He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C. "
[3] Today, learned State Counsel, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 11.01.2024 and is no longer required for further investigation. [4] In view of the aforesaid, the order dated 11.01.2024-, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
