Jaswant Singh,J(Oral) Petitioner while working as a Sub Inspector with Haryana Police was imposed with major punishment of compulsory retirement vide order dated 13.6.2006 on culmination of disciplinary proceedings. He filed a suit challenging the aforesaid order of compulsory retirement, which was dismissed. The first appellate Court vide judgment and decree dated 3.6.2010 allowed the suit of the petitioner/plaintiff and while setting aside the order dated 13.6.2006 ordered his reinstatement with all consequential benefits. RSA filed by the Police Department was dismissed by this Court on 28.4.2015. It transpires that the petitioner had in the meanwhile reached the age of superannuation on 31.1.2012.

After arguing for sometime learned counsel for the petitioner prays for permission to withdraw the present contempt petition to enable his client to initiate execution proceedings for executing the decree. In view of the above,dismissed as withdrawn with liberty aforesaid.
