(ORAL) Though, in the present writ petition, the challenge is to the order dated 04.12.2020 (Annexure P-2), by which, the petitioner has been placed under suspension, but on being pointed out that as per the settled principle of law suspension is not a punishment and it is not the allegation of the petitioner that the authority, which has passed the order dated 04.12.2020 (P-2) did not have the jurisdiction to do so, learned Senior counsel appearing on behalf of the petitioner submits that the petitioner will not press his claim qua the impugned order dated 04.12.2020 (P-2), at this stage.

Learned Senior counsel further submits that the petitioner is to attain the age of superannuation on 31.01.2022 and in case, the NARESH KUMAR 2021.01.13 16:53 I attest to the accuracy and integrity of this document Chandigarh

CWP-716-2021 -2proceedings are not finalized by the said date, the same will cause prejudice to him and therefore, his only prayer is that the proceedings, if initiated against him, be finalized in a time bound manner before the date of his superannuation.

Notice of motion.

Ms. Ambika Bedi, AAG, Punjab, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition accepts notice on behalf of respondents-State. Learned State counsel, on instructions from the respondents, submits that in case the petitioner cooperates during the disciplinary proceedings, if initiated, the same will be finalized within a period of six months from today.

Learned Senior counsel appearing on behalf of the petitioner submits that keeping in view the statement recorded on behalf of the respondents-State, the grievance of the petitioner stands redressed and he does not want to press this writ petition any further and the same may be disposed of as such.

Disposed of, as having been not pressed any further. It is made clear that the respondents-State will be bound by their statement, recorded hereinabove.
