Petitioners was convicted by trial Court vide judgment and order dated 4.2.2006 in a case under the provisions of Prevention of Corruption Act. The appeal preferred by him is pending final adjudication before this Court. He filed CWP 18498/2016 impugning order dated 28.3.2016 whereby he had been dismissed from service as also initiation of departmental proceedings vide charge sheet dated 11.2.2016.

Since his statutory appeal filed under Haryana Civil Service (Punishment and Appeal)Rules,1987 was still undecided by the authority concerned, the said writ petition was disposed of vide order dated 7.9.2016 with a direction to authority concerned to expedite the final decision on the statutory appeal filed by the petitioner within a period of three months from the date of receipt of order dated 7.9.2016. Now instant contempt has been filed alleging disobedience of said order dated 7.9.2016.

COCP 3307/2016 At the time of hearing today short reply by way of affidavit of S.Singh,Joint Secretary to Government of Haryana, Urban Local Bodies Department, has been filed. The same is taken on record. In para 3 of the said affidavit it is stated that in compliance of the order passed by this Court petitioner was granted personal hearing on 21.4.2017 and thereafter a speaking order of even date(R-1) has been passed.

In view of the contents of affidavit filed today and noticed above, it is apparent that the instant contempt petition has become infructuous.

Ordered accordingly.
