Petitioner filed CWP 20491/2016 seeking promotion from the post of Associate Professor and Head of Department of Post Graduate,Department of English to the post of Principal. It was her claim that as per benchmark set up for promotion, she was entitled for promotion.

The said writ petition was allowed vide order dated 3.12.2016 by directing the respondents to promote the petitioner as Principal with effect from the date her juniors were promoted in the promotion quota vide order dated 27.5.2016 with all consequential benefits except monetary benefits which shall be notionally fixed. The needful was to be done within two weeks from the date of receipt of certified copy of the order dated 3.12.2016.

Now instant contempt has been filed alleging disobedience of order dated 3.12.2016 passed by this Court. Notice of motion was issued.

COCP 3313/2016 On 14.3.2017 counsel for the respondent prayed for week's time to comply with the order dated 3.12.2016 and the hearing was adjourned to today.

At the time of hearing today, counsel for the respondent has produced a copy of order dated 17.3.2017 passed by respondent whereby petitioner has been promoted as Principal, on notional basis w.e.f. 27.5.2016 i.e. the date when her juniors were promoted. Copy of the said order is taken on record. Joining report dated 24.3.2017 of petitioner as Principal has also been produced which is also taken on record.

In view of the above,learned counsel for the petitioner concedes that the instant contempt petition has been rendered infructuous.

Dismissed as infructuous.
