Petitioner has filed the instant petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case bearing FIR No.65 dated 11.10.2022, registered under Sections 323, 458 read with Section 34 of the Indian Penal Code and Sections 25 & 27 of the Arms Act, at Police Station Rure Ke Kalan, District Barnala. 2.
Learned counsel for the petitioner, at the outset, submits that inadvertently he could not mention regarding dismissal of the earlier petition for anticipatory bail, and accordingly, he may be permitted to withdraw the instant petition. It is further submitted by learned counsel for the petitioner that the petitioner is ready to surrender before the trial Court, however, an appropriate direction may be issued to the trial Court that in case petitioner APURVA 2024.05.02 10:13 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CRM-M-1163-2024 -2surrenders before it and files an application for grant of regular bail then the same may be considered/decided in a time bound manner. 3.
Keeping in view the aforesaid submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn. 4.
In case the petitioner surrenders before the trial Court within a period of one week from today and moves an application for grant of regular bail then the same shall be considered and decided within a period of two days of the filing of such application.
