RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner - Raju in a case arising from FIR No.32 dated 26.03.2018 registered under Sections 302, 148, 149 IPC at Police Station Lopoke, District Amritsar. According to the prosecution, in the day time of 20.08.2016, Raju and Manga, friends of Mangal Singh took Mangal Singh from his house. Thereafter, in the evening Mangal Singh was found dead in Manawala Canal. Police kept on sitting over the matter for around two years. However, after around 11⁄2 years, on 26.03.2018 Mukha Singh and Lakhbir Singh made statement before the police. On the basis of that statement, raising suspicion upon the petitioner and five others, police arrested petitioner on 09.04.2019.

-2CRM-M-905 of 2020 accused of the petitioner, namely, Lovedeep Singh alias Ranjit Singh alias Labha and Daleep Singh have been released on regular bail. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Treating the case of the petitioner on the same parity as that of his aforesaid co-accused, he may also be granted concession of regular bail inasmuch as entire case is based on circumstantial evidence.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, treating the case of the petitioner, namely, Raju on the same parity as that of his aforesaid co-accused, he is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
