Petitioner alleges violation of order dated 6.12.2016 passed by this Court in CWP 26789/2015, whereby official respondents were directed to consider the case of the petitioner for promotion to the post of Principal from the date his juniors were promoted in the promotion quota. He was further held entitled for all consequential benefits except monetary benefits which were to be notionally fixed. The necessary exercise was to be undertaken within a period of four weeks from the date of receipt of the said order.

In the instant contempt petition, notice of motion was issued for today.

None is present on behalf of the petitioner.

COCP 3268/2017 Singh, IAS,DPI(C)Punjab. The same is taken on record. It is stated in the said affidavit that pursuant to the directions of this Court dated 6.12.2016 passed in CWP No.26789/2016, the petitioner has been notionally promoted as Principal w.e.f. 9.10.2015 i.e., the date of promotion of his juniors. A copy of such order dated 24.11.2017 has been annexed with the affidavit as Annexure R-1. Further, an unconditional apology has also been tendered for any lapse or misunderstanding. In view of the above, in my opinion, the instant contempt petition has become infructuous and no further action is required. Dismissed as infructuous.
