Learned State counsel submits that all retiral benefits have been released to the petitioner except death cum retirement gratuity. This was due to disciplinary proceedings pending against the petitioner. However, same have culminated by now. In view of same, a speaking order shall be passed with regard to the balance retiral dues and any other issue which survives at the earliest, in any case not later than one month. In view of above, this court feels that no cause of action survives in this petition. Same is disposed of. Petitioner shall, however, be at liberty to challenge the speaking order, if so advised.
