By way of this petition filed under Section 482 Cr.P.C, petitioner challenges the order dated 20.12.2022 (Annexure P.4) whereby warrant of arrest has been issued against the petitioner in criminal complaint titled "Parul Bansal Vs. R.G. Residency Pvt. Ltd. etc., (NACT/94/2019) under Section 138 of the NI Act pending in the Court of learned JMIC, Panchkula. It is contended that the petitioner has not been served even once. Bailable warrants issued against him were received back unserved despite which warrant of arrest has been issued.

It is conceded by learned counsel that the petitioner has not appeared even once before the trial Court, though the offence in question is bailable. Since offence in question is bailable, therefore, this petition is disposed of with a direction to the petitioner to appear before the trial Court on or before 30.01.2023., the date already fixed. On his such appearance, his bail application shall be considered by the trial Court on the same date.
