When the matter was taken up in the pre-lunch session, learned counsel for the respondent pointed out that in terms of interim orders passed by this Court on different dates, in the present revision petition, total due amount as on date, which is payable by the petitioner to the respondent, is Rs.5,00,000/- (Rs. Five Lakhs only).

Rebutting the said claim, learned counsel for the petitioner submitted that only an amount of Rs.1,00,000/- is payable as on date, and not Rs.5,00,000/-, as claimed by the respondent. However, she prayed for some time to seek necessary instructions with regard to making of payment of Rs.5,00,000/-, as claimed by the respondent today before this Court, and if feasible, the requisite amount shall be transferred in the bank account of the respondent today itself.

2023:PHHC:085267 CR-193-2023 (O&M) - 2 - counsel for the petitioner informs the Court that an amount of Rs.5,00,000/-, as claimed by the respondent, has already been transferred in the name of the respondent in her ICICI Bank account, bearing A/c No.017701610707 (IFSC Code: ICIC0000177), through RTGS from State Bank of India, vide UTR No. SBINR52023070658280918, today itself. A copy of the counter foil for RTGS/NEET, dated 06.07.2023, has been produced and taken on record. Office to tag the same at appropriate place in the case file. 4.

In the above backdrop, while addressing arguments in Civil Miscellaneous Application No. CM-7968-CII-2023, learned counsel for the petitioner submits that the petitioner be allowed to withdraw present revision petition. While making prayer for withdrawal of the main revision petition, learned counsel submits that she has instructions to state at the bar that the petitioner would be abide by his statement regarding payment of maintenance amount, which has been recorded in the order by the Coordinate Bench of this Court in CR-193-2023.

In view of the above, Civil Miscellaneous Application No. CM7968-CII-2023 is allowed, and the main case i.e. CR-193-2023 is hereby ordered to be dismissed, as having been withdrawn. 6.

In view of the fact that main case (CR-193-2023) has already been withdrawn by the petitioner, all the pending miscellaneous applications filed by either side also stands disposed of.
