Learned State counsel submits that SLP preferred by State against order of Division Bench was dismissed as withdrawn on 10.02.2012. He further submits that it is not possible for the State to implement the order passed by writ court as petitioner is lodged in a jail in Gorakhpur, Uttar Pradesh in view of case registered against him. He has produced a copy of the communication which is taken on record as mark 'A'. Aforesaid contention remains uncontroverted as none appears on behalf of the petitioner. Petitioner remains unrepresented on last two dates of hearing as well.
In view of above, this petition is dismissed as having been rendered infructuous.
