***** RAMENDRA JAIN, J. (ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to the petitioner, in case FIR No.234, dated 27.11.2018, under Section 379 IPC at Police Station City, Phagwara, District Kapurthala.
According to the prosecution, petitioner by developing friendship with the daughter of the complainant, who is studying in 10+2 standard visited the house of complainant in the night on 30.08.2018 and stole away Rs.3.80 lakhs in cash besides gold ornaments from the almirah of his house with the help of his friend, who was sitting outside in the car. His daughter under the fear did not disclose the above mis-happening, committed by the petitioner for around one month. Learned counsel contends that there is delay of 1 month in lodging the FIR. CRM-M-906 of 2019 --2-- Considering the seriousness of the allegations, this Court is not inclined to grant the concession of anticipatory bail to the petitioner, inasmuch as, recovery of gold ornaments and cash amount is to be effected from the petitioner. Therefore, his custodial interrogation is very much required.
Accordingly, the petition is dismissed.
